The ACA: Going Away or Here to Stay?
This is a big year for the Affordable Care Act. Not only do we have a presidential election between two candidadates who have VERY different views of the health reform law, but this Fall, the Supreme Court will determine the fate of President Obama's signature legislation. Texas v. United States contends that, without the individual mandate, the ACA is unconstitutional. Will the court agree? And what happens if it does?

In times of turbulence and confusion in the marketplace, brokers don't need to have all of the answers; they just need to know more than their competition. And 2020 is definitely a time of turbulence and confusion...
Back in 2012, we put together a four-hour "health reform boot camp" to try to help brokers understand how health reform would change the way they do business. Hundreds of agents from across the state of Texas attended, and, considering that everything was up in the air at that point, we were pretty accurate with our predictions.
As federal regulators issued the rules and regulations to implement the ACA and the major provisions went into effect, we did an eight-hour Boot Camp in 2014 followed by another four-hour session in 2015. Again, hundreds of brokers attended, and the feedback was overwhelmingly positive.
With the new president threatening to kill the cost-sharing subsidies, insurers debating whether to continue offering individual coverage or not, and lawmakers moving forward with their Obamacare repeal efforts, there was a lot of uncertainty in the market in 2017. Brokers were unsure what they should tell their clients and what changes they should make to keep their existing business and take advantage of any opportunities that may arise. In short, there was a lot to talk about in the 2017 boot camp.
Now it's 2020, and things aren't going so well. Yes, the ACA has survived the first three years of the Trump presidency, but premiums are through the roof, there's not enough competition in the market, and we're in the middle of a global pandemic that's exposing some of the problems with our health care system. It's also an election year, and the Supreme Court of the United States will soon be deciding the fate of health care law. There's a lot to talk about, and this year's boot camp promises to be truly unique.

We'll start with a quick look at all of the big changes (and the impact of those changes) over the past 12 months, including some of the decisions made during the COVID-19 health emergency. We'll also discuss the upcoming election, the positions of President Trump and Vice President Biden, and the pending Supreme Court case.
It's getting harder and harder to help clients who purchase coverage in the individual market, but believe it or not there are still some innovative solutions you can recommend, including short-term health plans.
Due to COVID-19, small businesses are struggling right now, and that's unlikely to change anytime soon. In the coming months, brokers will need to get creative to help their clients. The good news is that there are still some great solutions for small employers, and brokers who are able to deliver those solutions will be rewarded with plenty of business in the months ahead.
For large employers, the mandate, employer reporting, and compliance remain big topics, though there have been some rule changes due to the coronavirus. We'll give an update on all three of those topics and discuss some strategies you can recommend to large employers.
This class wouldn't be complete without a discussion of the future of the ACA, so we'll talk about four possible scenarios: 1) Trump wins and the Court finds the law unconstitutional; 2) Trump wins but the Court upholds the ACA; 3) Biden wins but the Court finds the law unconstitutional; 4) Biden wins and the Court upholds the ACA.
